Legal Drafting and Conveyancing is an elective subject in postgraduate programs offered by the Faculty of Law. This subject provides an introduction to the elements of legal drafting and the principles of residential property conveyancing in Queensland. Drafting - Issues to be considered include questions of style, legalese and plain English, drafting of statutes, wills and contracts and computer-aided drafting. Conveyancing - The Standard Land Contract in Queensland is examined and the basic concepts inherent in contracts for the sale of land are dealt with. This subject is compulsory for students seeking admission in Western Australia, and recommended for those seeking admission in Malaysia.

1. Understand the principles of plain English drafting. 2. Development of practical legal drafting skills. 3. Understand and be familiar with the specific legal principles that apply to Queensland residential conveyancing. 4. Understand and be familiar with the REIQ Contract for Houses and Land (current ed). 5. Be able to engage in discussion regarding contractual terms, legislation and areas of reform.
Assumed knowledge is the minimum level of knowledge of a subject area that students are assumed to have acquired through previous study. It is the responsibility of students to ensure they meet the assumed knowledge expectations of the subject. Students who do not possess this prior knowledge are strongly recommended against enrolling and do so at their own risk. No concessions will be made for students’ lack of prior knowledge.
Assumed Prior Learning (or equivalent):
Students must be into a Masters law degree OR LA-43040 Doctor of Legal Science (Research) OR be an approved Law Study Abroad or Law Exchange student.
This subject is not available as a general elective. To be eligible for enrolment, the subject must be specified in the students’ program structure.
