Abstract:
This session will provide an accessible introduction to international arbitration as a method of resolving cross-border commercial disputes. It will explain the defining features of arbitration, including party autonomy, confidentiality, procedural flexibility, enforceability of awards (including under the New York Convention), and the role of arbitral institutions and tribunals.

The session will then move from theory to practice by outlining the types of matters commonly encountered in Hong Kong, with particular reference to complex, high-value disputes, often arising out of infrastructure, energy, and broader commercial projects, and the typical lifecycle of an arbitration, from early case assessment and strategy, to interim measures, evidentiary phases, hearings, and award.

Finally, the session will offer a candid perspective on career pathways into international arbitration, including how Australian-qualified lawyers can pursue opportunities, what skills and experience are most valued, and what day-to-day professional life looks like for an international arbitration lawyer practising in Hong Kong.
