Compliance

Understanding Australia's regulatory framework for international education is a core part of your obligations as a Bond agent. This section provides guidance on the key compliance requirements you need to be across.

The ESOS Act and National Code

The Education Services for Overseas Students Act 2000 (ESOS Act) sets the legislative standards for Australian universities delivering courses to international students on a student visa. As a Bond agent, you operate within this framework.

Key obligations under the ESOS Act and National Code include:

  • Providing accurate and ethical information about Bond programs and costs
  • Not making false or misleading claims in promotional materials
  • Ensuring students understand their visa conditions and study obligations
  • Referring students to Bond for matters beyond your scope or expertise

Mandatory training on the ESOS Act and National Code is required for all Bond agents.

Genuine Student requirements

The Genuine Student (GS) requirement is part of Australia's student visa assessment process. The Department of Home Affairs (DHA) assesses whether an applicant is a genuine student with the intention to comply with their visa conditions.

Bond has developed simplified documentation to support agents with ensuring students are meeting Bond's GS requirements when requested.

Bond’s Education Agent Partners must not assist or influence students in transferring to other providers within the first 6 calendar months of their principal course without Bond’s approval and must report all transfer requests within 3 days.

Bond will not pay any fee to an Education Agent Partner when they support a student who is transferring from another provider without the completion of their principal course as indicated in their CoE.
