LAWS13-561: Law of Succession and Administration of Estates

Description

Law of Succession and Administration of Estates is an elective subject in undergraduate programs offered by the Faculty of Law. This subject will provide a brief overview of enduring documents and their relationship to succession law, family maintenance and the role of personal representatives. The specific topics to be covered will be: an introduction to enduring documents; introduction to wills and other transactions; making and execution of wills; alteration, revival, republication and revocation of wills; death, burial and cremation; personal representatives, probate and administration; payment of debts and order of application of assets; legacies, devises and beneficiaries; intestacy and family provision.

Learning outcomes

  1. Demonstrate an understanding of Succession Law in Queensland including legislation and relevant legal resources
  2. Demonstrate knowledge of and apply the principles of estate planning
  3. Demonstrate knowledge of the historical development of relevant legislation in response to social and economic change
  4. Demonstrate knowledge of and justify the role of a personal representative in administering an estate
  5. Evaluate the intersection between equitable principles and succession rules in context

Assumed knowledge:

Assumed knowledge is the minimum level of knowledge of a subject area that students are assumed to have acquired through previous study. It is the responsibility of students to ensure they meet the assumed knowledge expectations of the subject. Students who do not possess this prior knowledge are strongly recommended against enrolling and do so at their own risk. No concessions will be made for students’ lack of prior knowledge.

Must be admitted into a Bachelor Law degree OR Bachelor of Laws combined degree OR be an approved Study Abroad OR Exchange Law Student.

This subject is not available as a general elective. To be eligible for enrolment, the subject must be specified in the students’ program structure.
