LAWS17-805: Law and Social Justice: Supporting Capacity and Capability

Description

Law and Social Justice: Supporting Capacity and Capability is an elective subject in postgraduate programs offered by the Faculty of Law in which undergraduate students may be permitted to enrol. The subject examines and evaluates how the law can best achieve the goals of social justice for people with disability in Australia.  A particular focus is the National Disability Insurance Scheme Act introduced in 2013 in response to Australia’s obligations to the UN Convention on the Rights of Persons with Disabilities.  The Scheme supports people with disability to build skills and capability so they can participate in the community and employment.  Significantly, the Scheme has created new business opportunities, start-up companies and growth of providers in an open marketplace.

Learning outcomes

  1. Examine contemporary Australian approaches to disability legislation.
  2. Identify key principles in various disability legislation and case law.
  3. Collaborate with others in various contexts whilst providing input on social justice and disability law.
  4. Draft a research report examining case law and relevant legislation.

Assumed knowledge:

Assumed knowledge is the minimum level of knowledge of a subject area that students are assumed to have acquired through previous study. It is the responsibility of students to ensure they meet the assumed knowledge expectations of the subject. Students who do not possess this prior knowledge are strongly recommended against enrolling and do so at their own risk. No concessions will be made for students’ lack of prior knowledge.

Must have completed a minimum 120 Credit Points of LAWS subjects AND have a minimum average of 65% in LAWS subjects. Students must be admitted into a Bachelor law degree or Bachelor of Laws combined degree or be an approved Law Study Abroad OR Law exchange student.

This subject is not available as a general elective. To be eligible for enrolment, the subject must be specified in the students’ program structure.
